    Wellness Program Regulation Amendments

    On May 17, 2016 the EEOC issued a final rule to amend the regulations and interpretive guidance implementing Title I of the ADA as it related to employer wellness programs which becomes effective January 1, 2017. 

    This presentation will address these new amendments including, for example, what constitutes voluntary participation in the program and the limitations to the financial and other incentives associated with wellness programs.  We will also examine the parameters of permitted disability related questions and submission to medical examinations as part of a wellness program along with the interplay between HIPAA and the new wellness program rules.

    Eileen has an extensive litigation practice that encompasses mass tort, products liability, pharmaceutical and employment litigation. She frequently represents clients in both New Jersey Superior Courts and the U.S. District Court for the District of New Jersey and possesses substantial knowledge of the local legal landscape in New Jersey.

    Eileen often serves as a key trial team member in major pharmaceutical litigation matters, providing essential insight on handling cases in the New Jersey court system and helping to bring significant matters to successful resolution. She has been involved in representing some of the world's largest pharmaceutical companies in mass tort litigation involving blockbuster drugs for osteoporosis (Fosamax®) and hair loss (Propecia®).

    Eileen is also well-versed in handling labor and employment law matters. She represents clients at the administrative level as well as in the New Jersey Division on Civil Rights, the EEOC and state and federal courts in cases involving wrongful discharge, unemployment appeals, breach of contract, illegal harassment as well as retaliation and discrimination claims, including appearance-based discrimination. Eileen also assists clients in a preventative capacity, such as performing in-house training on anti-harassment issues, supervisory skills, family leave and how to implement discipline to employees. She also reviews company policies and employee handbooks and has assisted employers in reductions in force.

    Eileen is a member of the Atlantic County Bar Association, the New Jersey State Bar Association, the Federation of Defense & Corporate Counsel and the New Jersey Attorney Ethics Committee (2005-2009).

    Eileen is a graduate of Stockton University and the Widener University School of Law.
